NPTA and Scheme Membership Declaration

 

Declaration

As part of my membership of the National Pest Technicians Association (NPTA) and, where applicable, registration under the TrustMark scheme, I confirm that I have read, understood, and agree to comply with the requirements set out in this declaration.

For the purposes of this document, “Scheme Membership” refers collectively to NPTA membership and TrustMark registration, where applicable.

I understand that ongoing compliance with these requirements is a condition of membership and registration.

 

Suitability for NPTA Membership

I confirm that the business applying for NPTA membership:

  • Is a bona fide trading entity and will, upon request, provide or permit access to evidence of financial standing, trading history, bona fides, or creditworthiness at residential and/or trading addresses.
  • Accepts that NPTA may carry out such background checks as it considers appropriate.
  • Will declare any County Court Judgements (CCJs) relating to residential or trading addresses, acknowledging that NPTA may independently verify such information and that consideration of spent judgements will be at NPTA’s discretion.
  • Complies with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR).

 

Legal, Health, Safety and Environmental Compliance

I confirm that, as part of Scheme Membership, the business:

  • Complies with the Health and Safety at Work etc. Act 1974 and all relevant health and safety legislation, and maintains appropriate documented policies, procedures, and records where required.
  • Complies with all applicable waste management regulations, including any licensing requirements for the carriage, transfer, storage, and disposal of waste.
  • Will notify the Scheme Provider promptly of any material changes, including:
    • Legal status or trading name
    • Trading address
    • Directors or persons of significant control
    • Operational capability or scope of services
    • Legal judgements relevant to the scope of registration

 

Consumer Protection and Fair Trading

I confirm that, as part of Scheme Membership, the business:

  • Complies with all relevant and current consumer protection and unfair trading legislation.
  • Acts fairly, transparently, and professionally in all dealings with consumers.
  • Takes appropriate steps when working with vulnerable consumers, allowing sufficient time for understanding, providing clear explanations, and encouraging third-party support where appropriate.
  • Ensures that an appropriate number of personnel hold Disclosure and Barring Service (DBS) checks where the business regularly works with vulnerable people.
  • Operates in a non-discriminatory manner and complies with all equality and anti-discrimination legislation.

 

Marketing, Sales and Contract Practices

I confirm that, as part of Scheme Membership, the business:

  • Complies with Advertising Standards Authority (ASA) requirements to ensure all advertising is legal, decent, honest, and truthful.
  • Provides written quotations, estimates, contracts (for values over £500 including VAT), contract variations, and cancellation notices, except where immediate emergency work makes this impractical.
  • Provides quotes, invoices, and contracts in accessible formats where reasonably required.
  • Allows consumers sufficient time to read, understand, and ask questions before entering into a contract.

 

Branding and Promotion

I confirm that, as part of Scheme Membership, the business:

  • Uses the NPTA and TrustMark names, logos, and branding only in accordance with the relevant brand guidelines.
  • Accurately and responsibly promotes the benefits of Scheme Membership to consumers.

 

Compliance, Monitoring and Cooperation

I confirm that, as part of Scheme Membership, the business:

  • Will make available to the Scheme Provider any records reasonably required to manage application, registration, and ongoing compliance.
  • Will allow access to sites, documentation, or personnel where reasonably required for assessment or review.
  • Will ensure suitable and competent individuals attend assessments or reviews where requested.
  • Will comply promptly with instructions issued to identify and resolve any non-compliance.
  • Will cooperate fully with any investigation or complaint process involving NPTA, TrustMark, or their appointed representatives.
